Welcome to Fiku! These terms govern your use of our food scanning and health analysis app. Please read them carefully before using our service.

The Simple Version

Paid Subscription App

Fiku starts with a 3-day free trial, then a subscription (monthly or annual).

AI Health Insights

Our AI provides health analysis for informational purposes – not medical advice.

Your Responsibility

You're responsible for your account and for using Fiku respectfully and lawfully.

1. Acceptance of Terms

By downloading, accessing, or using the Fiku mobile application ("App") or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users of the Service, including visitors, registered users, and subscribers. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Fiku is a mobile application that helps you make informed food choices by:

  • • Scanning product barcodes to retrieve product information
  • • AI-powered health analysis that provides personalized health scores
  • • Additive detection that reveals hidden ingredients and their effects
  • • Allergen warnings based on your dietary preferences and allergies
  • • Healthier alternatives recommendations for scanned products
  • • Consumption tracking and health analytics over time
  • • Personalized recommendations based on your health goals
  • • Apple Health integration to sync nutrition data with the iOS Health app
  • • Push notifications for scan reminders and health insights
  • • Referral program allowing users to invite friends and earn bonus scans

3. Subscription & Payment Terms

Subscription Plans

  • • Monthly Plan: Billed monthly at the current rate displayed in the app.
  • • Annual Plan: Billed annually at a discounted rate.

Important Billing Information

  • • Payment is charged to your Apple ID account upon confirmation of purchase.
  • • Your subscription automatically renews unless cancelled at least 24 hours before the end of the current period.
  • • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • • You can manage and cancel your subscription in your App Store account settings.

Refund Policy

Refunds are handled by Apple through the App Store. If you believe you are entitled to a refund, please contact Apple Support directly through your purchase history. We do not have the ability to process refunds directly.

4. User Accounts

Account Creation

  • • You must be at least 13 years old to create an account.
  • • You may sign up using email/password or Apple Sign In.
  • • You are responsible for maintaining the security of your account credentials.
  • • You must provide accurate and complete information when creating your account.

Account Responsibilities

  • • You are solely responsible for all activity that occurs under your account.
  • • You must notify us immediately of any unauthorized use of your account.
  • • You may not share your account with others or transfer your subscription.

5. Acceptable Use

  • • Use the Service for any illegal purpose or in violation of any laws
  • • Attempt to reverse engineer, hack, or compromise the Service
  • • Upload false, misleading, or malicious product information
  • • Abuse the product reporting system with false reports
  • • Use automated systems or bots to access the Service
  • • Resell, redistribute, or commercially exploit the Service
  • • Interfere with or disrupt the integrity of the Service

6. Apple Health Integration

Fiku offers optional integration with Apple Health (HealthKit). When you enable this feature, Fiku may read and write the following health data types: dietary energy, macronutrients (protein, carbohydrates, fat), and other nutrition-related data from products you scan and log.

Apple Health data is stored locally on your device by Apple and is not transmitted to Fiku's servers. We only read Health data to personalize your nutrition insights, and write data so you can track scanned product nutrition within Apple Health.

You can revoke Fiku's access to Apple Health at any time through the iOS Health app settings. Disabling access will not delete previously synced data from Apple Health.

Fiku will never use Apple Health data for advertising, marketing, or data mining purposes. Health data is never sold or shared with third parties.

7. Push Notifications

Fiku may send push notifications to your device with your permission. Notifications may include scan reminders, health insights, streak updates, and important account information.

You can manage or disable push notifications at any time through the app's notification settings or your device's system settings. We use Expo Push Notification Service to deliver notifications, and your device push token is stored securely on our servers solely for this purpose.

We do not send promotional or advertising notifications. Notifications are limited to features you have opted into.

8. Referral Program

Fiku offers a referral program that allows you to invite friends. When a referred friend creates an account and verifies their email, you earn 25 bonus scans.

Referral links contain a unique referral code associated with your account. You may share your referral link freely, but you may not use automated systems, bots, or deceptive practices to generate referrals.

Fiku reserves the right to revoke bonus scans or suspend accounts that abuse the referral program, including creating fake accounts or self-referring.

9. Health Information Disclaimer

Important Medical Disclaimer

  • Not Medical Advice: The health information, scores, and recommendations provided by Fiku are for informational purposes only and should not be considered medical advice, diagnosis, or treatment.
  • AI Limitations: Our AI analysis is based on available ingredient data and general health research. It may not account for your specific medical conditions, medications, or individual health needs.
  • Allergy Warnings: While we strive for accuracy, always verify allergen information directly on product packaging. Fiku should not be your sole source for allergen detection.
  • Consult Professionals: Always consult with qualified healthcare providers for medical advice, dietary planning, or concerns about specific ingredients.

10. Intellectual Property

The Fiku name, logo, app design, AI algorithms, and all related content are the property of Fiku and are protected by intellectual property laws.

  • • You may not copy, modify, or distribute our proprietary content.
  • • Product information and images remain the property of their respective owners.
  • • User-submitted content (product photos, corrections) grants us a license to use and display that content within the Service.

11. Limitation of Liability

To the maximum extent permitted by law:

  • • Fiku is provided "as is" without warranties of any kind, express or implied.
  • • We do not guarantee the accuracy, completeness, or reliability of product data or health analysis.
  • • We are not liable for any damages resulting from your use of or inability to use the Service.
  • • Our total liability is limited to the amount you paid for the subscription in the 12 months preceding any claim.
  • • We are not responsible for decisions you make based on information provided by the Service.

12. Account Termination

Your Right to Cancel

  • • You may cancel your subscription at any time through the App Store.
  • • You may delete your account and data from within the app settings.
  • • Cancellation takes effect at the end of your current billing period.

Our Right to Terminate

  • • We may suspend or terminate accounts that violate these Terms.
  • • We may discontinue the Service with reasonable notice.
  • • Upon termination, your right to use the Service immediately ceases.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Apple App Store Terms

The following terms apply to users who download the Fiku App from the Apple App Store.

Acknowledgement

These Terms are between you and Fiku only, not with Apple Inc. ("Apple"). Apple is not responsible for the Fiku App or its content.

Scope of License

The license granted to you for the Fiku App is limited to a non-transferable license to use the Fiku App on any Apple device that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and Support

Fiku is solely responsible for providing maintenance and support services for the App as specified in these Terms, or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Warranty

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Fiku's sole responsibility.

Product Claims

Fiku, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to:

  • • Product liability claims
  • • Any claim that the App fails to conform to any applicable legal or regulatory requirement
  • • Claims arising under consumer protection or similar legislation

Intellectual Property Rights

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Fiku, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Legal Compliance

You represent and warrant that:

  • • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country
  • • You are not listed on any U.S. Government list of prohibited or restricted parties

Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).

Third Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
